NYK-Fil Ship Management, Inc. (NYK-Fil) respects your right to privacy and aims to comply with the requirements of all relevant privacy and data protection laws, particularly the Data Privacy Act of 2012 (“DPA”). The purpose of this policy is to explain what type of information and the purpose of its collection. It also defines how we process your personal data in terms of how it is stored, who has access to your information, how it is archived, as well as disposal and possible sharing with third parties. In addition, this policy is meant to advise you of your rights under the DPA.
This policy applies to all information we collect from you or about you, and we only collect it after obtaining your explicit consent to do so. In this policy, the terms, “data” and “information” are used interchangeably.
We collect the personal data of our applicants/crews, which includes the following and any other pertinent information:
NYK-Fil processes personal information from applicants/crews primarily to recruit, deploy, and maintain world-class merchant marine personnel for NYK Line and its subsidiaries. The same information will be stored in the database of NYK-FIL for record-keeping, historical, and statistical purposes.
Personal information is collected, acquired, or generated in various forms – whether electronically or in paper – upon your express consent.
To the scope allowed or required by law, we may also share, disclose, or transfer your personal info to other persons or organizations, such as to Principal/Shipowners as well as to government agencies, like POEA, MARINA, OWWA, SSS, PhilHealth, PagIBIG, among others to uphold your interests and/or pursue our legitimate interests as a manning company.
However, within NYK-FIL, only authorized personnel has access to these personal information.
All personal information will be stored in a database for as long as you have active employment with the company and up to three years if inactive, after which physical records shall be disposed of through shredding while digital files shall include destruction of the hard drive where the same are stored..
NYK-FIL employs reasonable safety provisions to keep your stored information secure as well as organizational, managerial, electronic, technical, and physical security measures to protect your personal information from breaches that would result in loss or misuse.
